Foreclosure Furor Rises Many Call for a Freeze

The uproar over bad conduct by mortgage lenders intensified Tuesday, as lawmakers in Washington requested a federal investigation and the attorney general in Texas joined a chorus of state law enforcement figures calling for freezes on all foreclosures.

Representative Nancy Pelosi, the House speaker, and 30 other Democratic representatives from California told the Justice Department, the Federal Reserve and the comptroller of the currency that “it is time that banks are held accountable for their practices.”

Many home buyers and sellers are not aware of the true value that a Realtor provides during the course of a real estate transaction. Many people, in fact, are not cognizant of the expertise, professional knowledge, and just plain hard work that go into bringing about a successful real estate transaction.

A multitude of important services and steps required in a real estate transaction are carried out by the Realtor or the brokerage staff. Most of these steps have traditionally been viewed simply as part of a Realtor's professional responsibilities to the client. But, without them, the transaction could be placed in jeopardy.

Listed below are nearly 200 typical actions, research steps, processes, and review stages necessary for a successful residential real estate transaction that are normally provided by a full service real estate brokerage in exchange for their sales commission. Depending on the transaction, some of these steps may take minutes, hours, or even days to complete, while some may not be needed.

Comprehensiveness

The list is by no means an attempt to set forth a complete list of services, as these can vary within each brokerage and each market. Many Realtors routinely provide a wide variety of additional services that are as varied as the nature of each transaction.

By the same token, some transactions may not require every step listed. However, given the unexpected complications that can arise, it's far better to know about a step and make an intelligent, informed decision to skip it, than to not know the possibility even exists.

The Realtor Commitment

The professional commitment of a Realtor is to ensure that a seller and a buyer are brought together in an agreement that provides each with a transaction that is fair and equitable. The motivation is easy to understand. For most full-service brokerages, they receive no compensation whatsoever unless and until the sale closes.

By contrast, there are firms that offer limited services in exchange for an up-front flat fee, or offer a menu of pay-as-you-go or a la' carte options. Other real estate firms may offer a sliding scale ranging from limited to full service. In these cases, the compensation of the Realtor is based on the reduced services provided, with the seller bearing full responsibility for all of the other steps and procedures (which are normally conducted by a full service real estate firm) in the selling process.

Variety Of Choices

The variety of brokerage business models in today's real estate industry - full service, limited service, fee for service or other -- affords consumers with a greater range of options than ever before. No matter which option they choose, homeowners should understand exactly what services will, or will not, be provided by their choice of Realtor/brokerage firm before signing a Listing Agreement or otherwise engaging the services of a Realtor and agreeing to compensation.

Why Use A Realtor

Not every real estate agent or broker is a Realtor. That term and the familiar block "R" logo are trademarked by the National Association of Realtors can legally be used only by those that are Realtor members through their local association of Realtors.

While all Realtors are also state-issued licensees as agents or brokers, a major difference between a real estate licensee and a Realtor is that Realtors have taken an oath to subscribe to a stringent, enforceable Code of Ethics with Standards of Practice that promote the fair, ethical and honest treatment of all parties in a transaction. Real estate licensees (those that have a state-issued license but are not members of a Realtor association) are not bound to the ethical practices and principles set forth in the Realtor Code.

In addition, Realtor associations offer a wealth of training courses to their member Realtors, to help assure that Realtors serve their customers with the level of skill, knowledge and attention to detail required in today's real estate transaction. The continual training provided to Realtors underscores the importance of having help and guidance from someone who fully understands the process - a Realtor.

For peace of mind, ensure that the individual seeking to represent you in a real estate transaction is not just a real estate licensee, but also a Realtor.

Pre-Listing Activities

1. Make appointment with seller for listing presentation.

2. Send seller a written or e-mail confirmation of listing appointment and call to confirm.

3. Review pre-appointment questions.

4. Research all comparable currently listed properties.

5. Research sales activity for past 18 months through the Multiple Listing Service (MLS) and/or public records databases.

6. Research "Average Days on Market" for this property of this type, price range and location.

7. Download and review property tax roll information.

8. Prepare "Comparable Market Analysis" (CMA) to establish fair market value.

9. Obtain copy of subdivision plat/complex lay-out.

10. Research property's ownership and deed type.

11. Research property's public record information for lot size and dimensions.

12. Research and verify legal description.

13. Research property's land use coding and deed restrictions.

14. Research property's current use and zoning.

15. Verify legal names of owner(s) in county's public property records.

Once Property Is Under Listing Agreement

38. Note any and all unrecorded property lines, agreements, easements.

39. Obtain house plans, if applicable and available.

135. Deliver unrecorded property information to buyer.

136. Order septic system inspection, if applicable.

137. Receive and review septic system report and assess any possible impact on sale.

138. Deliver copy of septic system inspection report lender and buyer.

139. Deliver Well Flow Test Report copies to lender and buyer and property listing file.

140. Verify termite inspection ordered.

141. Verify mold inspection ordered, if required.

Tracking The Loan Process

142. Confirm verifications of deposit and buyer's employment have been returned.

143. Follow loan processing through to the underwriter.

144. Add lender and other vendors to transaction management program so agents, buyer and seller can track progress of sale.

145. Contact lender weekly to ensure processing is on track.

146. Relay final approval of buyer's loan application to seller.

Home Inspection

147. Coordinate buyer's professional home inspection with seller.

148. Review home inspector's report.

149. Enter completion into transaction management tracking software program.

150. Explain seller's responsibilities with respect to loan limits and interpret any clauses in the contract.

151. Ensure seller's compliance with Home Inspection Clause requirements.

152. Recommend or assist seller with identifying and negotiating with trustworthy contractors to perform any required repairs.

153. Negotiate payment and oversee completion of all required repairs on seller's behalf, if needed.

The Appraisal

154. Schedule appraisal.

155. Provide comparable sales used in market pricing to appraiser.

156. Follow-Up on appraisal.

157. Enter completion into transaction management program.

158. Assist seller in questioning appraisal report, if questions arise.

Closing Preparations And Duties

159. Contract is signed by all parties.

160. Coordinate closing process with buyer's agent and lender.

161. Update closing forms and files.

162. Ensure all parties have all forms and information needed to close the sale.

163. Select location where closing will be held.

164. Confirm closing date and time and notify all parties.

165. Assist in solving any title problems (boundary disputes, easements, etc) or in obtaining Death Certificates.

166. Work with buyer's agent in scheduling and conducting buyer's final walk-through prior to closing.

167. Research all tax, Home Owner Association, utility and other applicable prorations.

168. Request final closing figures from closing agent (attorney or title company).

169. Receive and carefully review closing figures to ensure accuracy of preparation.

170. Forward verified closing figures to buyer's agent.

171. Request copy of closing documents from closing agent.

172. Confirm buyer and buyer's agent have received title insurance commitment.

173. Provide Home Owners Warranty for availability at closing.

174. Review all closing documents carefully for errors.

175. Forward closing documents to absentee seller as requested.

176. Review documents with closing agent (attorney).

177. Provide earnest money deposit check from escrow account to closing agent.

178. Coordinate this closing with seller's next purchase and resolve any timing problems.

179. Have a "no surprises" closing so that seller receives a net proceeds check at closing.

180. Refer sellers to a Realtor at their destination, if applicable.

181. Change MLS status to Sold. Enter sale date, price, selling broker and agent's ID numbers, etc.

182. Close out listing in transaction management program.

1. Get prequalified for a mortgage. You’ll be able to make a firm commitment to buy and your offer will be more desirable to the seller.

2. Stay in close contact with your real estate agent to find out about the newest listings. Be ready to see a house as soon as it goes on the market — if it’s a great home, it will go fast.

3. Scout out new listings yourself. Look at websites where you can browse mls listings, look through your local newspaper’s real estate section, and drive through the neighborhood to spot "For Sale" signs. If you see a home you like, write down the address and the name of the listing agent. Your real estate agent will schedule a showing.

4. Be ready to make a decision. Spend a lot of time in advance deciding what you must have in a home so you won’t be unsure when you have the chance to make an offer.

5. Bid competitively. You may not want to start out offering the absolute highest price you can afford, but don’t go too low to get a deal. In a tight market, you’ll lose out.

6. Keep contingencies to a minimum. Restrictions such as needing to sell your home before you move or wanting to delay the closing until a certain date can make your offer unappealing. In a tight market, you’ll probably be able to sell your house rapidly. Or talk to your lender about getting a bridge loan to cover both mortgages for a short period.

7. Don’t get caught in a buying frenzy. Just because there’s competition doesn’t mean you should just buy it. And even though you want to make your offer attractive, don’t neglect inspections that help ensure that your house is sound.

1. Have you built substantial equity in your current home? Look at your annual mortgage statement or call your lender to find out. Usually, you don’t build up much equity in the first few years of your mortgage, as monthly payments are mostly interest, but if you’ve owned your home for five or more years, you may have significant, unrealized gains.

2. Has your income or financial situation improved? If you’re making more money, you may be able to afford higher mortgage payments and cover the costs of moving.

3. Have you outgrown your neighborhood? The neighborhood you pick for your first home might not be the same neighborhood you want to settle down in for good. For example, you may have realized that you’d like to be closer to your job or live in a better school district.

5 Feng Shui Concepts to Help a Home Sell

1. Pay special attention to the front door, which is considered the “mouth of chi” (chi is the “life force” of all things) and one of the most powerful aspects of the entire property. ESTIMATING VALUE IS A COMBINATION OF ART AND SCIENCE
Homekeys was the first company in the US that offered FREE online estimations of property values to the residents of the State of Florida. Our Realtors believe their clients should have transparent access to all elements needed to make rational buying and selling decisions, and what can be more important that “property values”.
Estimating property values is easier said than done. Without exception, we all believe what we have is worth more than what it is actually worth to others. And this “gap in perception of value” becomes bigger during tough economic times as we are going thru now.
The challenge is to establish an objective, unemotional baseline for buyers and sellers so distressed sales and emotional purchases become the exception, not the rule.
It is no secret that sellers want to sell high and buyers want to buy low. But they often arrive at the negotiating table with very different ideas on price. A fair and objective property valuation can help buyers and sellers find common ground and streamline the negotiation process.
In the end, the property is worth what a buyer is willing to pay. But to help both buyers and sellers achieve their goals, both should have a fair and objective estimate of property value.
Unfortunately, even objective estimates are still estimates, and there is no way to assure 100% accuracy:
· Appraisals performed by a certified appraiser are not 100 percent accurate.
· CMA’s (Comparable Market Analysis) and BPOs (Broker Price Opinions) performed by a licensed broker or agent are not 100 percent accurate.
· AVM (Automated Valuation Model) technology is not 100 percent accurate.
All these methods, when properly executed, can provide a good indication of value.
However, we need to keep in mind that estimating value is a combination of art and science. Regardless of how scientific the approach, the actual sale price is subject to the unique variables of each property transaction: property condition, upgrades, current market conditions, circumstances of the sale and individual tastes.
For property owners, pricing correctly is a key to a successful sale.
1. Under-pricing can result in a fast sale, but carries the risk of leaving money on the table.
2. Sellers who price too high may find their properties lingering on the market, and statistics show that values can erode at a rate of about 1.5 percent per month.
3. Longer sales also increase the likelihood of a “distressed sale” when sellers become frustrated or encounter difficult financial circumstances.
Likewise, buyers should avoid emotional purchases. Overpaying because of "falling in love” with a home is common.
The science of AVMs
To determine a good baseline value for a property, Homekeys searches thousands of property records for comparable sales or “comps.” Homekeys uses advanced statistical models and proprietary algorithms and formulas to find the best comparable properties available. In addition to property characteristics, the system evaluates how recent comparable sales are and how close properties are from the property being evaluated. Once a base property value estimate is determined, it’s time to check active listings to see what similar properties are selling for.
The art of AVMs
The art portion of estimating value begins with understanding how comparable sales and active listings compare to the property being evaluated. Since they are nearby, it’s a good idea to drive by comparable sales and listed properties to see how they compare. To help you stay organized, you may want to use a buyer checklist when visiting properties.
After researching comparable sales and active listings, it’s time for the personal touch. Sellers know their own property and neighborhood better than anyone, so they are able to adjust base values according to individual property characteristics. Buyers can make similar adjustments as they visit properties to help formulate an asking price.
Depending on your research, a “market adjustment” may be warranted. If active listings are priced higher than your base estimated value, an upward adjustment may be appropriate. If prices are lower, a downward adjustment might be in order.
Finally, Homekeys enables buyers and sellers to make other value adjustments based on individual property characteristics and condition. Based on a seller’s knowledge or a buyer’s research, appropriate value adjustments can help both parties arrive at a fair selling price.
And though no property valuation system is perfect, AVMs can provide objective valuation estimates quickly and inexpensively, and the technology is improving all the time. As AVM technology continues to evolve and improve, it may prove to be a key to less-stress, more enlightened real estate transactions in the future.

Using the Research Parcel
Each week we will be featuring a new tip to help you take full advantage of the tools Homekeys has to offer. This week's tip is "Using the Research Parcel." If you have any suggestions about tips you'de like to see, feel free to Contact Us.
The Research Parcel is a very useful tool when you want to know information on properties surrounding the one you are interested in. This is a great feature because you can go through the neighborhood of the property you�re looking at and get an idea of what other homes in the area are worth and what they sold for in the past.
Click the button to activate the tool and then click on the center of a property. A window will pop up with the property�s address and estimated value. You have the option to view details, which will give you the county record information on the property. In addition, you can choose from aerial view, comparables, or estimated value.

When you close the pop-up window a yellow box with the estimated value will be placed on top of the property. You can do this for as many properties as you like.
The Research Parcel works a little different when it comes to condos. When you click on a condo building you will get a list of the units inside. From there you can select a unit and get all the same information you would get from any other property. When you close the pop up window, now the yellow box displays the number of units in that building.

Is the Real Estate Industry Going to Be Different When We Recover From the Current Downturn?

It depends on who answers the question. Traditional real estate agents want to preserve the status quo; new entrants are trying to create a new game; and consumers want the best of both worlds: full service at discount prices. However, there is little doubt that the economic downturn is exacerbating the situation, but the reality is that it is only the tip of the iceberg. Prior to the downturn our industry was in the midst of a major transformation, as changes in consumer behavior and new technologies were driving innovations that we had not seen during the last 50 years. The truth is that consumer behavior impacts technology and technology impacts consumer behavior and as such cannot be ignored.
The economic downturn is going (and will continue) to impact consumer behavior. Our clients (and fellow neighbors) are experiencing the effects of the worst financial and economic crises since the depression of the '20s. The impact of these times upon our ways of thinking and behaving are impossible to determine, but a few patterns are emerging, among others:
1. Say goodbye to the equity-rich syndrome so prevalent a few years ago. Welcome equity preservation. Buyers and sellers will look at every single aspect of the process and seek ways to minimize transaction costs. Is the existing commission structure going to survive? It will not unless the role of the agent is changed. People are willing to pay for "value-added" support, but it will be up to the new breed of agents to convince the consumers.
2. Say goodbye to leveraging. Leveraging your life will no longer be possible as financing in every sense of the word will be available only to those who have the ability to serve the debt regardless of how low the rates are. How will this impact the number of agents? This translates into fewer agents, but those remaining will have a bigger slice of the pie.
3. Say goodbye to part-time agents. The days of part-time agents are gone, and this will benefit those individuals who are fully dedicated to the profession. This may be a good opportunity to raise entry barriers. Like in any profession, there are good agents and bad agents. However, it is too easy to obtain a real estate license, and traces of unethical behavior that are now found everywhere must be eliminated. This is the time to do it.
4. Welcome back savings. Saving will no longer be looked at as the exception, and people in general will have to work harder to earn less. The wounds of this economic downturn will be deep and will take time to heal. Living within your means will be the rule and not the exception. Consumers will be looking at every single economic and financial decision in their lives with a new set of glasses.
But in addition to the impact of the downturn on consumer behavior, the technologies around all aspects of our lives will continue to drive behavioral changes that will significantly impact the way real estate is transacted.
1. The Internet has leveled the playing field by making available to the consumer information and data previously controlled and limited by the agents. Consumers and agents will have equal access to the information, (which) will shift the control of the process to the consumers. Consumers will have instant access to property values and the tools to find the best deals in real estate.
2. The Internet will bring down transactional costs. Advances in technology and the ever-increasing sophistication of consumers are destined to change the way homes are bought and sold. Did the industry fail to recognize changes in the behavior and expectations of homeowners and investors? Today's consumers are tech-savvy, more independent, more sophisticated, more knowledgeable and want to be in control. They want to have choices. These choices will include but will not be limited to full service real estate, discount real estate and flat fee MLS options.
Almost every traditional brokerage house has a Web site that is mostly used to provide photographs and summarized property information. This is a step in the right direction, but not quite what the consumer wants.
Consumers want access to the same information and tools that professionals have. They want a buy-and-sell process that is easier, smarter, faster and cheaper. Consumers know that the Internet has made it possible to have access to information and resources that in the past only were available to professionals.
The Internet has also made it possible to provide these services at a fraction of the cost. Technology-based models are not a substitute for good judgment, but they are more efficient and transparent. These efficiencies result in lower cost of representation, and access to information and know-how that is completely unbiased and independent of the value of a property. Put another way, technology drives down the cost of representation.
The challenges in front of us are big and many. However, the future is as equally bright as the past. Those that understand the impact of the new technology on the consumer behavior will excel; others will fail, And do not blame it on the economy!

Often the biggest obstacle to becoming a homeowner is coming up with enough cash for a down payment. One way for cash-strapped home buyers to realize their dream is to lease a home with an option to buy.
Here's how a lease option works. The buyer (called an optionee) leases the property from the seller (called an optionor) for a period of time. The lease contract gives the optionee the right to buy the property at the end of the lease period, or earlier by mutual agreement, at a price agreed upon in the contract.
The optionee pays a sum, called option money, to the seller at the onset of the lease. This money is applied to the purchase price if the option is exercised. The option money is forfeited to the seller if the optionee doesn't go through with the purchase.

I enjoyed Michael Miller’s timely article “Realtors insist ethics missing” (Feb. 4) at a time when our country is facing one of the most difficult real estate crises.There is no doubt many buyers — first-time or otherwise — lack the fundamental knowledge of basic finance. However, it is the moral, ethical and legal responsibility of the so-called experts in transacting real estate to protect the rights of the stakeholders involved in the process.Yes, the lending institutions failed by placing their own economic interest ahead of shareholders and borrowers. These institutions are the same that irresponsibly provided financing to developers and contractors to overbuild our communities.And, obviously, this same group provided the financing to many who should never have purchased. Bottom line: Record number of foreclosures and write-offs, and hundreds of thousands in many industries associated with real estate will now join the ranks of the unemployed. The industry system of “checks and balances” totally crashed or maybe it never existed. Our instant-gratification mentality fueled by an exuberant amount of greed has destroyed the American Dream and many of our communities.Elia Ceniceros is totally right. She said, “There’s a lot of unscrupulous and unethical agents out there that may have done that to clients, but the problem is that when the client turns around and needs the agent to help them, the agent is no longer in the business.” So true, but why are we surprised? Very few Realtors have any skin in the game.Our industry has more part-timers and retirees than any other. These individuals are not committed to the long-term prosperity of the industry. When the tide is high and easy money is to be made you will find them in herds, but when the tide is low and they have to work hard for their so-called clients, they simply disappear.Most of these are there to make a quick buck and undoubtedly the means justify the ends. These individuals need to close in order to earn a commission and as such they have consistently manipulated the process to their advantage.We need to “professionalize” the Realtor’s role. This in turn should result in a significantly better-prepared Realtor and, among other things, a financially literate one. I have met many agents who do not have the slightest idea about basic finances. Immigrants are very vulnerable. Would you not think an agent could play an instrumental role in protecting them? It boils down to morals and ethics. It has nothing to do with legality. It is about time as an industry and individuals we become “socially responsible.”

“We are going to see our industry go through dramatic transformation via the Internet and consolidation of agents and companies.” – eRealty Times Columnist Dirk Zeller once said. How prophetic!

Some industry observers have adopted Harvard Business School professor Clayton Christensen’s term “disruptive technology” to explain recent developments in real estate. Though it’s easy to point to the World Wide Web and advancing technology as the main changes in real estate, that’s only part of what’s shaking things up. Essentially, the real cause of disruption is not just technology, but technology-enabled real estate consumers.

Who are these Web-enabled consumers?
According to the National Association of Realtors (NAR), more than 80 percent of homebuyers now begin their home search online. The popularity of online real estate ads surpassed newspaper property listings back in 2001, and the gap is widening. You must advertise online because your potential clients “live and die” by the Web. They just do not know any other way. And the trend will continue to grow. Just remember, these web-enabled consumers do everything online, from dating to anything you can think of.
These consumers are tech savvy. They know what they want and where to find it. And if they don’t, one of their friends will. They also want to act on their time. They resent being pressured to act. And not least important, they have been accustomed to have free and unlimited access to information in every single aspect of life and real estate is not an exception. They are willing to pay but based on the value of the services received.
So, if you believe that you can survive without the web you are committing suicide. It is not going to happen.
On the other hand, there will always be a place and time for the “face to face” contact between clients and agents. This, however, will be the exception and not the rule.

Who will survive?
Let’s face it. The consumer is always right. Moreover, they always tell you what they want. The problem is that sometimes we do not want to listen. We cannot handle change. Change hurts especially when it attacks the foundation of the business model that has existed for the last 50 plus years. Is this a generational thing? Yes to a large degree. The older you are the more difficult it is to accept that there are ways to buy and sell real estate. It is even more difficult to justify the traditional 6 plus percent commission structure. So it boils down to the efficiencies and economies of scale that only technology can deliver.
Those that have access to those technologies will survive and prosper, the others will simply become part of larger tech based real estate technology companies.
But at the end of the day, many agents will be displaced and there will be fewer agents as we know them today.

It's an irony of the current market that with all the homes offered for sale, many serious buyers can't find a home to buy. There are often certain types of homes, in certain areas, that just aren't on the market. These are usually prime properties in excellent condition that have broad-based appeal. When these listings come on the market, they are usually snapped up quickly, despite the otherwise slow housing market.

Many buyers are sitting on the fence at this point, watching the market and waiting for a better time to buy. It's impossible to time the housing market, so you won't know precisely when the market will next correct until that correction has already occurred. A market correction can be verified only through hindsight.

Although most buyers feel more comfortable buying in a hot market -- even though it may mean paying more -- there are some buyers who see a slow market as a good buying opportunity.

A Rising Tide Lifts All Ships...and nothing could be farther from the truth in real estate!

When real estate fever hit its peak sometime ago, it was almost impossible to go wrong, and all realtors looked like geniuses. This irrational market resulted in thousands of individuals joining the ranks of the real estate profession. After all, it was easy to get a license and- with limited effort- the economic reward was significant. We simply have too many agents!

While it is going to take sime time for the market to recover, we are beginning to witness some signs of consolidation. Many "part-time" agents that should had never been here to begin with are now disappearing. This offers a great opportunity to the many "full time professional agents" that have been fully committed to the industry to regain control of the process.

These agents do not complain about market difficulties. They continue to work hard serving their existing and prospective clients. And consumers will be able to tell who these agents are: they really know what is going on and share all information with their clients in an unbiased and transparent manner.

Today consumer survey shows buyers are in it for the long-haul, planning to stay in their home for a median of 10 years. This is a wise approach to housing because the longer you own, the better your investment.

New-home sales are projected at 773,000 for 2007, and declining to 669,000 this year before rising to 730,000 in 2009, but well below the 1.05 million 2006. With an appropriate slowdown in production, housing starts, including multifamily units, are forecast at 1.36 million for 2007 and 1.09 million this year before edging up to 1.10 million in 2009; starts totaled 1.80 million in 2006. The median new-home price should drop 2.1 percent to $241,400 for 2007, and then rise 0.4 percent to $242,200 this year and gain another 5.9 percent in 2009.

According to the latest forecast by the National Association of Realtors, America’s largest trade association, representing more than 1.3 million members involved in all aspects of the residential and commercial real estate industries.

Cut your home for sale listing asking price until a buyer appears

Cut or hold?

With this week’s news that home prices fell 4.5 percent in the third quarter, a lot of people with real estate to sell have to make some tough decisions. Do they cut their asking price enough to get a contract, or do they hold out for the inevitable recovery?

The big question is, how long will they have to wait? Perhaps the best way to answer that question is to look at the last period in which home prices began to fall, as measured by the widely followed S&P/Case-Shiller index of home prices.

If the current slump follows the same pattern as in the 1990s, it could be a long wait. As you remember, it took nearly seven years for the prices to recover and resume their upward climb from the 1990 levels.

The usual “past is not prologue” caveats apply, of course. But I don’t see a lot of reasons to think the current cycle will be any shorter or less painful than previous one, for several reasons:

· The disappearance of the subprime mortgageBear-Stearns-Troubles Nov-07 market has reduced the amount of money available for purchasing property.

· We’re in the early stages of a wave of foreclosures that will put more homes on the market, dragging down prices further.

· The current of homes is now at a 22-year high, and sales are down 31 percent from two years ago.

As a real estate broker uses the auction method to sell properties, I gain a different perspective on this. The auction is the exact opposite of a “wait it out” approach. Rather than wait for buyers to agree to pay a certain price, the seller agrees to sell “at the market” on a particular day. Another choice for many people is to simply cut their asking price until a buyer appears.
Either way, the sale price will likely be lower than it might have been last year, but it may well turn out to be higher than some of the prices ahead.

We've all spent a lot of time lately talking about the oversupply of properties in previously overheated markets, and about the difficulty of getting property sold in the current environment. But it's good to remember that there's one way to be certain of a sale no matter what's going on around you. Pricing within the market, “The price is right”.

Demand for reverse mortgages on the rise

As recently as December 2007 the Senate committee on Aging spent time discussing the aggressive marketing and sales techniques being used by mortgage institutions to attract senior homeowners into purchasing reverse mortgages. As larger populations of seniors are turning 63 every year, the demand for reverse mortgage loans are on the rise. There was a 56% increase in these types of loan in 2006 from the prior year. The Federal government in December 2007 removed the restrictions to the number of outstanding reverse mortgage loans they would underwrite at any given time. Prior to the new legislation, the original limit was 275,000.

Many of the largest banking institutions are now getting involved including Bank of America who just recently acquired Reverse Mortgage of America, a division of Seattle Mortgage Co. This is one of many acquisitions occurring in the mortgage industry to capture a stronghold on the reverse mortgage loan market. It is this activity that has gained the attention of the Federal and State governments. Congress is exepcted in 2008 to put more laws into place that provide stronger protections and minimize the commissions and flat fees mortgage companies can charge per loan.

Tech-Based Real Estate Won’t Lose Face

The real estate industry is being changed by companies like Zillow, FNIS, RealEstateABC, Trulia, Redfin, ZipRealty and others including our own Homekeys.

All these companies have different business models but share a passion for change and the use of technology for the benefit of the consumer. From free and unlimited access to data, information and resources (previously the exclusive domain of real estate professionals) to significantly lower transaction costs and anything in between.

The incumbents appear to be concerned about the increased use of technology and how it will impact the traditional business model including the role of the real estate agent. With great conviction, the new entrants are pushing the envelope, innovating and preaching the consumer mantra to stake their claim in this $65 billion industry. This has become a fundamental area of debate and unrest within the industry participants, consumer watchdogs and regulatory bodies. No one is to blame, as each party is doing its duty to protect their interests. The answer, however, is being hinted by the consumers.

We believe the face of the real estate agent will be human but technology will be the heart and soul. Empowering technology will afford consumers a more active role in the transaction process, freeing the real estate agent to spend more time providing value with expertise, guidance and attention to transaction details.

Because of technology, the industry will become more transparent, more professional and more efficient. Today’s consumers are fiercely independent and technologically sophisticated. They have become increasingly familiar and comfortable with eCommerce and all sorts of “online social encounters”. Our clients grew up with toys like mobile phones, laptops, the Internet, blackberries, and companies like Google, Yahoo, AOL, Expedia, Ebay, Amazon, Realtor.com, Lending Tree and hundreds of others. They even date online and are willing to share their lives on blogs and in sites like My Space. These trends are expected to continue. Our industry, like all others, is completely reliant on its consumer base; does it seem logical to presume that it will be immune to these structural and permanent changes in consumer behavior?

Our industry is not immune. We will have to embrace change sooner rather than later. Agents will be challenged to keep abreast of the latest technological developments in a world of increasing consumer expectations. Technology will redefine the barriers of entry to the industry and its adoption will play a major role in the success or failure of the real estate professional. It should not come as a surprise that historically these barriers have been among the lowest of any industry. Technology will flush the pipeline. There will be fewer agents and their role will be less that of “matchmaker” and more that of “advisor”. Technology will bring down commissions but agents will net more because there will be fewer but significantly more productive agents.
Tech-based real estate companies will streamline and automate all processes that can be automated within the value chain. Short of conducting physical property inspections, consumers will be able to complete the majority of tasks online while relying on interaction with real estate professionals for their expertise when necessary. Online consumers can already conduct powerful map searches, estimate property values, get neighborhood info and comparable sales, view satellite images and county data. It may not be long before they schedule virtual viewing appointments and use ground level photography and advanced mapping to drive around the neighborhood. They’ll then walk around the inside of a home with their remotely conferenced agent and his counterpart asking their questions. If they like the home, they may proceed to virtually drive the comps.

Technology cannot longer be hoarded to perpetuate the existing business model and the traditional roles of agents. Other industries tried and failed because consumer expectations would not allow it. And life is too short to pursue regulation and legislation as the drivers to preempt competition.

Change is here to stay. Change fuels innovation and creativity and is a prerequisite for progress.

The companies and real estate professionals that provide and leverage technology will increase the value of “face-time”. Consumers will be able to take a more active role and the real estate professional will spend their time where they provide the most value: delivering expertise, guidance and attention to transaction details. Those companies will be rewarded by the consumer.

After all, it is always the consumer, who has the final word!

There are so many questions that surround technology and its continuous expansion. It seems never ending and that every month a new gadget comes into the market, or a new version of a current program is available. There are endless innovations and improvements. One major concern is how technology affects consumers.

Has technology put a dent in face time? Face time is an interaction a person has with another individual that is physically present. It is not a phone conversation or a written email. In today’s world where 7 year olds have cellphones, is it that important anymore to be physically there?

In order to buy or sell a property, has technology helped facilitate the process by providing tools and information that were never before available to consumers? Or is it hurting the consumer by withholding the face time provided by traditional Real Estate Agents in order to provide quicker and more informative service? Is face time only necessary for some transaction like buying a car, and not necessary for others like ordering a pair of shoes?

Has technology built a wall between people or provided more information to make better decisions? Maybe technology provided too much information…

There are countless answers and opinions to all these questions, but it is important to remember that technology has not yet reached its pinnacle. It has yet to achieve greater expectations and further break barriers. In the upcoming year, how will technology affect real estate?

What will websites like Homekeys, Zillow, Redfin and others do to support buyers and sellers and make itself stand out from each other? This is a question that has no direct answer, the only way to find out is to wait and see.

Resolutions in 2007

The New Year brings the availability of a re-do of sorts. The infamous resolution. Something we are going to change about ourselves or our behavior in the new year. Most people really don't take advantage of this gift and most people should.

For the resolution to be meaningful it must be personal. The classic resolution is going to the gym or going on a diet. Things that are meant to make ourselves feel better about us. Why not this year commit to doing something for someone else.

Your resolution does not need to be something you do all year long. It could a single day spent helping someone. Or it could be spending a weekend enjoying life with the ones you love.

Mother Teresa said that our first ministry is to our family. If that was our resolution this year think of the amazing things families could do all year long.

Here are my two resolutions for the year:
1. To put my family first, then others, and then myself. Every decision based on this simple premise that joy can only be found when we decide not to be selfish.

2. Show my children the love I have for their mother. Allow them to feel safe and secure in that knowledge.

Listen to your gut and take advantage of this re-do. It only comes around once a year.

Halfback

Halfback does not always mean Football’s running play. The word is also used to label long time Florida residents who are moving to the Carolina's upstate region, since it means they have moved halfway back North.

The Herald Tribune, based in Southwest Florida ran a story about those in that area who are migrating to the halfway states. There are many who are moving from Sarasota and Manatee Counties, but in general it is retirees who are seeking retirement havens. The reasons for the move vary, but halfway states provide a different lifestyle. There is much less congestion with people and traffic, and above all it is less expensive as well as easier to live.

Some may wonder how different it would be to move from a happening city to a rural area, but South Carolina’s region is not all rural. And for the areas that are rural, half of the Hispanics who migrated in the past few years moved to the rural areas. In addition to this, there are many people from around the world, especially corporate retirees who crave the relaxing atmosphere and mountain views.

There are also many international companies including BMW’s plant near Spartanburg.

Properties are much more affordable and though there is a state income tax, the low property taxes make up for it. It is also a buyer’s market in South Carolina, but they have not experienced the over or under stock of inventory that South Florida has.

Green guidelines

As the century continues and the risk for Global Warming increases each day, it’s good to know that some companies are taking measures to become environmentally friendly.

According to The Boston Globe, Boston is in the process of requiring private development firms to follow “green-building” standards.

The purpose of these strict standards is to make Boston buildings more energy efficient and friendly to the environment by using recycled materials as well as resourceful heating and cooling systems. In today’s world of hybrid cars and solar powered gadgets, I think it is only time before more industries try to convert to more environmentally friendly resources.

I am the Graphic Designer here at Homekeys, and having been raised in Boston, I think they are proposing a great requirement for private builders. Being energy conscious, I think this is a step in the right direction for everyone’s future. I wonder how things would be different today if we had only known to be more energy conscious 30 years ago? Either the heating or cooling system is used year round in Boston and wastes a lot of There are currently many U.S. cities that have adopted green building standards, but only for public buildings and development.

When the Boston Zoning Commission adopts these standards next month, Boston will be the first major market to require private builders to follow these guidelines.

This affects real estate in many ways because developers will now have to certify that they have met the green-guidelines and the city will have to confirm. Developers are worried that it will be more difficult to start projects this way.

Is the number of pounds we gained as a team as all 13 of us gobbled our way through all the pork, ribs, and flan one could think about. After stuffing our faces and most of us having seconds, we finally exchanged presents.

The list goes like this: Manolo had Bill, Bill had Ally, Ally had Carlos, Carlos had Mario, Mario had John, John had Robert, Robert had Manolo, Jose had Mary, Mary had Yani, Yani had Rick, Rick had Jen(me), Jen(I) had Vivian and Vivian had Jose.

We got all sorts of gifts, but at least 4 of us got some type of liquor. Like Los said, it was no secret and a few minutes after the gifts were distributed, everything was figured out and in the end we all knew who our Secret Santa was. I never knew that once we got the gift, that it is still a secret and we are still not supposed to say whose Secret Santa we were. So as one can imagine, I was one of the first to confess.

After the food and presents, our CEO Manolo gave a speech about how Homekeys is getting better every quarter and about our plans to expand for the future. Soon after that, we were ready to bring out the dominos to give Manolo and Mario a chance to regain their title as champions that Yani and her friend stole during our Christmas party. As for real estate, we are now ready to tackle the phones and our individual tasks with satisfied bellies and happy faces.

Homekeys Secret Santa

After waiting a year, time has come for the annual Homekeys Secret Santa. I really don't understand why the word "secret" is involved because minutes after the names are distributed, I (LOS), know just about who everyone has. I have been called a sorts of names, "Splinter" and "Scrooge", to name a few, however its not my fault I always have time to consult a fellow colleague. Tomorrow, at 12:30, we will be exchanging gifts and stuffing our faces thanks to Yani (not the greek singer) a.k.a. "Danger", who always manages to be in charge of every Homekeys event. By the way, if anyone knows where I can get free ringtones for my new "Treo" I would greatly appreciate it. My wife couldn't keep a secret and gave it to me last night.

It feels good when you get positive feedback, especially when you have spent such a large amount of time doing your best to get it right. This current version is very powerful and easy to use.

The press and news stations in Hillsborough County have scheduled time to talk to us about ValueSearch™. Hopefully early next year you will see us on the news and in the paper. They are excited to have our tools available in their county.

We are still working on Orange County and it is going well. We can't wait until most of Florida can experience and leverage our power search.

Do what you say and do it right

Problem 1:
I take my car in today for an oil change and tire rotation. Several hours later I get a call that the car is ready. I pay and get my keys and go to my car. As I pull out of the parking spot I hear my passenger side rear tire banging against the wheel drum. I immediately stop and notice they never tightened the lug nuts on the wheel and one is missing.

Question 1: Didn't he hear that when he pulled the car out of the bay?
Question 2: What else did he forget to do?

So I carefully drove the car back to the bay and they re-tightened all the tires. I have to wait until Monday for the missing lug nut.

Problem 2:
My partner hires a roofing company to replace his roof. The roof was damaged during the 2005 hurricane season. The roof was started several months ago. To make a long story short. Half his roof is done and now needs to be pulled off and re-done from scratch.

Conclusion:
I could continue with these stories all night. How is it possible that quality and customer service does not exist anymore? Everytime I do something or go somewhere I have to worry what problems I am going to have. If I ran my business like this I would be out of business. Needless to say I won't be going back to this mechanic ever again. As for the roof, these guys just started my roof so please pray for me.

New Counties Coming Soon

For those of you who are waiting with great anticipation we are currently working on Orange and Pinellas counties in Florida. We are expecting to have one of those two counties available in the application late January early February. The next county following very soon after.

For those of you outside the state of Florida don't despair. We are currently looking at which state will be next. Here are the leading candidates in no particular order.

Georgia, Arizona, North Carolina, New York, Pennsylvania, and Seattle.

I will let you know when we finalize our decision.

Open Listing Service Crazy

When we (Homekeys) built our business plan back in 2003 we talked about allowing agents and homeowners to list their homes for free on our site. The first version of our software had what we called the OLS®, Open Listing Service. Even today we provide the OLS for free.

It seems in the last few months web site after web site is now providing a version of the OLS for free. Googlebase, Trulia, Propsmart, Homegain, and Zillow. Zillow has already acquired more than 7000 listings from agents and homeowners since their announcement last week.

I wonder if this is the beginning of the end for the MLS associations and their IDX feeds. It would be great if we all could gain access to any listing in the country through a RSS XML based feed. Googlebase seems to be the front leader but don't count Zillow out.

Zillow and Redfin at it again

It seems Zillow has their game plan laid out pretty clearly. First provide AVMs through out the county and gain strong site traffic. Then add home for sale listings by asking both agents and home owners to list their homes directly on the site. This will not only increase site traffic but put a dent in the Realtor.com foothold. Plus they don't need to be a licensed real estate corporation anywhere. Now when every home buyer and seller is going to Zillow.com, provide a transaction model that also does not require the need to be a licensed real estate company. It is very clear with the publication of Zillow's patent application for an online real estate auction site, that sometime next year we should witness this evolution.

What will be more interesting is to see how Redfin reacts to Zillow's implementation of 'Make Me Move'. Something that Redfin filed a patent application for last year. Either Zillow does not believe Redfin will be rewarded this patent or they don't care because they know Redfin's patent application is years out from being rewarded. If Redfin is rewarded the patent by 2009 that would be quick. Who knows where Zillow will be then.

It is just amazing how Zillow, Fidelity, Homekeys, and Redfin are changing the landscape for online real estate. The only guarantee is that something new will happen next week. The question is who will it be about next?

RE/MAX on TV

Who has seen the latest TV commercial for RE/MAX? They are pitching that you can see millions of listings throughout the United States on their web site. I first started looking for listings in Florida and then in New York. I was surprised what I found. Each area of the country has a different RE/MAX based web site. In the Florida site there is a lot of feature functionality but in the New York site there is a more traditional interface.

In the Florida site they provide several ways to find properties including the use of standard maps and GIS based mapping. If there is one negative about the interface is that they did not consolidate the listings from multiple MLS system for a given area. When I choose to search listings for Broward County, I was asked to choose a data source. In Broward County there are 4 data sources, one for each MLS association. This means I have to conduct the same search 4 times to see all the listings.

I loved all the different ways you could search for a home. They had a traditional page based interface. For technical users they had a GIS map interface or simply you could choose a City, MLS number, Address, or Zip Code. Each interface was easy to use and straightforward.

Other minor issues I had were that several times when using the map feature I received server errors and had to refresh the browser. Not having a list of the properties on the page to choose from after the search was very fustrating. The only way to navigate through the listings was to hover over the little house icons on the GIS based map. When I was ready to change states there was no way to navigate off the Florida site. I needed to retype the main domain again in the address bar.

In the New York site there is no GIS mapping interface. You have the ability to select from the traditional filters including schools. Not very exciting. In fact I was hard pressed to find a listing that did not belong to RE/MAX.

It is easy to find problems and things you don't like about a site. The Florida RE/MAX site is extensive and provides a lot of functionality. I have real confidence that over time these problems will be corrected. If your searching for listings outside of the Florida counties that Homekeys provides, then RE/MAX Florida is a great site to use.

Even though I love to talk about the technology here at Homekeys, I would be amiss not to tell you about our operations. Our buyer services are offered for the entire state of Florida and our sellers service are currently in 26 Florida counties. We currently have over 380 active customers and we service those customers with a staff of 13 people.

If you call us most likely you will reach Ally or Yani. These two girls are amazing. They provide customer service for many of the phone calls that come in. They help out everyone they can in the office and always do it with a smile.

When it is time to work with a Homekeys Realtor then you will talk with Carlos or Vivian depending if you are a buyer or seller. Carlos works with all of our sellers. He knows how to help each customer with their individual needs. What is amazing is how he provides the personalized service with the large number of customers he handles. Vivan works with all of our buyers. Every time I walk by her desk I hear her on the phone making sure each customer is prepared and excited. She is great at working with other Realtors and scheduling all the appointments.

When a contract is presented to one of our sellers or a buyer has presented a contract then our Brokers get involved. Whether it is Jose or John, they make sure the deal gets done. They are very experienced with negotiations and closing. If there is a will, there is a way with these guys.

Tour of ValueSearch™

In recent days I have been talking about ValueSearch™. Today you have an opportunity to see it for yourself. Click on the Sample Search link to start your tour.

You now have a browser open with a search already conducted. You are seeing a search for listings in the city of Doral, Miami-Dade county Florida. Notice the list of properties that were found in the grid below the map. You will see three important pieces of information at the end of each row in the grid, 'Sale Price', 'Estimated Value', and the 'Percent of Difference'. You should also notice that the grid is sorted by 'Percent of Difference'. Select any listing in the grid and that listing we be found on the map with more detailed information including a picture if one has been provided.

Here is the cool part, find the slider bar in the lower right hand corner of the map. This slider will allow you to filter the result set of listings by value. Using your mouse, click and hold the left mouse button down on the slider button. You will see a popup appear with information about the markers position. Included in that information is the number of listings that meet that criteria.

Now slide the marker down the slider bar and see how the number of properties change. Slide the bar to one of the hash marks where there are properties and release the mouse button. Now you will get a new map of only those homes that meet the new ValueSearch™ criteria you specified.

Go back to the grid and find the 'Sale Price' column. Click on the words 'Sale Price' in the column header so the grid sorts by sale price. Sort results are always based on the selected column and then the percent of difference. This way the best deals are always presented first.

SEO and web based marketing

You know what keeps me up at night more than anything? Wondering if today is the day Google or Yahoo completly flushes all of my optimized pages from their engines. Once you start a SEO project it completely consumes you. White hat, black hat, who's winning the game today and why. Everyday checking to see how many pages you have cached and how they are doing. Knowing that without a page 1 presense on Google or Yahoo your business does not exist.

I am now starting my third iteration of design and content for my optimized pages. Hoping that I can get another three months of quality placement and conversion. It seems every three months I begin the slow decline of falling off the face of the earth.

I am so impressed with Trulia when it comes to SEO. It seems everything they are doing is cutting edge SEO. Always keeping in front of the search engine companies. Making sure their pages not only have relevance but are highly usable. It is part of their business model so they should be experts. At least that is what I tell myself.

I have learned a lot over the past 15 months since I started on this journey through hell. I know within a few weeks of effort and long nights, once again my pages will rank well and my existence will be restored. I also know that in April I will be back here looking at making these changes again.

As you can tell I am really looking foward to the next two weeks of my life.

The consumers will have the final word

In response to ongoing coverage about changes in the real estate industry, I wanted to share my thoughts with you as the CEO of a business that is determined to bring value to the consumer.

Change is good for the consumer and for the real estate industry. It fuels competition and drives innovation and efficiency. Yet, the real estate industry has seen little change during the last 50 years. Indeed, other than marginally lower commissions as a result of the introduction of “discount brokerage models,” the change is imperceptible.

So, two questions that come to minds are: Will the industry survive as we know it today? What will it take to thrive in the future?

Technology and changing consumer behavior will be the driving forces behind change, but not the only forces. What matters is what the consumers want -- not what we think they want.

We searched for answers. We went from denial, to awareness, and finally to acceptance. The lessons were harsh but clear. We needed to listen and learn from the consumer. Here is what we learned and want to share with you.

1. Legislation and regulation can’t stop evolution and innovation.

It is not business as usual anymore. Prior success no longer guarantees the future viability of the existing real estate business model and profitability for the industry. While it has been a long and rewarding ride, its time has passed. However, there should not be any doubts that there is a bright future for the real estate industry. After all, real estate will continue to be the heart and engine of our economy. And it will be especially brighter for those embracing radical change and seeking new ways to serve the consumers. Those that embrace the change brought by evolution will succeed. Those that continue to use legislation to defend the indefensible will see their business succumb to innovative models that put the interests of the consumer at the center of the process.

2. Consumers have lost confidence in the traditional model.

Is anyone surprised about this? Have consumers been taken for granted? Did the industry forget that consumers are critical on both sides of the transaction? You would have thought that consumers would be in control of the process. Yet, ironically, consumers do not have any leverage because the power resides with intermediaries. Consumers’ options are limited when buying or selling real estate, particularly for those who want to go about it on their own.

We hear frequently: “Why do we need to pay a 6% commission for selling our property?” That concern is being felt across the real estate industry, and while commissions are being reduced, the decrease is still not commensurate with the “homeowner’s perception of value.

Homeowners believe that fees should be based on “the value of the services” and not on “the value of the property.” The adage that a rising tide lifts all boats has proved to be true in the real estate industry. This rising tide has brought housing values to record high levels. The good news for the homeowners is that their equity has increased. The bad news (which materializes at the time of the purchase and sale of property) is that such increase is completely independent of the contributions of third parties. It is simple market forces at work: supply and demand.

3. Consumers see through the lack of transparency.

Consumers know that you are not what you write or say, but what you do when no one is looking. Consumers want more transparency. They want all the myths to disappear. They want a leveled playing field, with unrestricted access to the tools and knowledge required for a successful sale or purchase. They want transactions that are “procedurally” easier, smarter, cheaper and faster. They want to choose how to go about buying and selling. The one size fits all approach is not longer valid.

Because of this lack of transparency, consumers are paying more for less value. Consumers are working more, but not being compensated for their efforts. Over 74% of buyers are now using the Internet to search for properties, yet they cannot complete the process because the back end is controlled by intermediaries. Sellers who want to sell on their own do not have an “effective platform” to market their properties, unless they use the Multiple Listing Service. The cost of representation currently based on the value of the property is archaic and does not reflect the realities of the times. The absolute value of commissions paid continues to increase and the beneficiary is not the consumer. It is the consumers’ equity that continues to erode, while the economic benefits are enjoyed by the intermediaries. Simply stated, the time has arrived for the consumers to be in control of the process. After all, the consumers own the properties and who better than them to decide what to do and how to go about it. They are willing to pay for the services and guidance they need, but not as a function of the value of a property.

4. The traditional model does not reflect today’s consumers.

Advances in technology and the ever increasing sophistication of consumers are destined to change the way home real estate is bought and sold. Did the industry fail to recognize changes in the behavior and expectations of homeowners and investors?

Today’s consumers are tech savvy, more independent, more sophisticated, more knowledgeable and want to be in control. They want to have choices!

Almost every traditional brokerage house has a web site mostly used to provide “photographs and summarized property information.” This is a step in the right direction, but not quite what the consumer wants. Consumers want access to the same information and tools that professionals have. They want a buy and sell process that is “easier, smarter, faster and cheaper.” Consumers know that the Internet has made it possible to have access to information and resources that in the past only were available to professionals. The Internet has also made it possible to provide these services at a fraction of the cost. Technology based models are not a substitute for good judgment, but they are more efficient and transparent. These efficiencies result in lower cost of representation, and access to information and know how that is completely unbiased and independent of the value of a property. Put another way, technology drives down the cost of representation!

5. Homeowners want real options, not a recycled traditional model.

While real estate is a $ 1.3 trillion industry that is highly fragmented, there is little differentiation between options. The industry also exhibits behavioral traits typically found in oligopolies. Consumers have been led to believe that the process of buying and selling is complicated and unmanageable without the intervention of an intermediary. This is simply not true. Consumers want real options that remove the “fear, uncertainty, and doubt,” which historically has been foisted on the real estate transaction by intermediaries.

There are over 2.3 million licensed brokers and agents in the United States. Entry and exit barriers are low. In theory, it looks like consumers have a very large number of choices. In practice, that is not the case. Mostly everybody offers the same and there is little differentiation between companies, business models, and services provided by brokers and agents. Consumers want “real choices,” not variations of the existing business model.

At the present time, real estate owners that wish to sell their property have two primary options: (i) sale by owner (FSBO); or (ii) a contractual engagement with a licensed real estate broker or agent.

For those owners who desire to sell their property themselves, advertising and valuation tools are virtually non-existent. Their intent is to avoid the high commissions sought by brokers, but they are restricted in their advertising and analysis capabilities.

Looking to take advantage of the market necessity for a FSBO real estate solution, a plethora of market developers has begun to introduce solutions in this area. Nonetheless, these developers have focused on creating revenue from either individual online FSBO advertisements, advertisements from or referrals to third-party real estate professionals, lead generation, or some basic set of information services/tools with limited capabilities. These are legitimate alternatives for some but not for all.

6. Real estate consumers are actively seeking alternatives.

Consumers have an infinite appetite for information and knowledge. Web based applications have made that possible and there is no turning back. According to a 2004 report from the National Association of Realtors, the Internet has rapidly become the preferred method of property search with over 70 % of homebuyers indicating that they utilize it as their primary source of property listings. In fact, 2003 marked a milestone in the technological evolution of the real estate industry. That year, for the first time, more buyers used the Internet than newspaper advertisements as an information source. Buyers are doing most of the work, yet they find themselves having to go through an intermediary. Buyers do not buy the myth that “Commissions are paid by sellers.” They know these commissions are part of the gross purchase price and paid exclusively by them.

First it was Homekeys who provided consumers free home value estimates of their homes in Florida. Then Zillow provided value estimates for 60 million homes in the country. Recently Fidelity National has provided a new web site (cyberhomes.com) for 100 million homes in the country and I am sure others will follow.

With the advent of Zillow's API, more and more web sites have popped up integrating Google maps with property and Zillow data. Now a new set of real estate web sites are starting to surface combining listings with estimated values provided by Zillow. Something Homekeys has been offering since March of 2005. We started building our technology in the summer of 2003.
